This Policy sets out the way in which we process information that directly or indirectly identifies you (Personal Data) as well as the rights you have, in particular when using the https://littledudes.be (Website).

This Policy is up to date as the expected date mentioned above. It is likely to be adapted, so we invite you to check its content regularly. You will be notified of any substantial changes to the Policy or these changes will be expressly mentioned on the home page of the Website.

Concepts such as "processing", "controller", "processor", "data subject", "personal data", etc. have the meaning given to them by the General Data Protection Regulation (GDPR) (Regulation No. 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data). 3.   Purposes of the processing

Your Personal Data is processed for specific purposes that differ depending on the type of relationship that Little Dudes maintains with you.

In order to enable us to provide our services, you are required to provide us with certain Personal Data necessary for their execution:

  • as a customer of Little Dudes, the Personal Data allowing to make a purchase on the Website;

  • if you are a supplier, we need to have certain Personal Data about you in order to manage our contractual relationship with you.

Little Dudes processes your data only for the following purposes:

  • if you are a customer of Little Dudes:

4.   Legal basis for processing

The processing of your Personal Data by Little Dudes is based on the following legal bases:


     a. Our contract with you

In most cases, we process your personal data necessary for the performance of our contract with you, i.e. in order to fulfil your order placed on the Website.

We only collect the data necessary for the execution of the order, i.e. those that allow us to communicate with you and deliver the purchased products to you.


     b. Our legitimate interest

In some cases, we may process your Personal Data because we have a legitimate interest in doing so.

This is particularly the case when we process your Personal Data in order to communicate with you or to provide you with information about our products outside of an order placed by you. In this context, our legitimate interest will be the continuation and development of our business activities. This assumption also covers "direct marketing", i.e. the use of your email address to send you communications relative to our activities, since you have already been our customer. You always have the possibility to object to receiving such communications (see Article 8).


     c. Your consent

In some cases, you can expressly give us your consent to the processing of your personal data, for example when you only subscribe to our newsletter without making a purchase on the Website. Once you have given your consent, you can withdraw it at any time.


5. Categories of Personal Data processed by Little Dudes

The categories of Personal Data that Little Dudes processes about you differ depending on the type of relationship Little Dudes maintains with you.

Customer

* Contact details (surname, first name, address, telephone, fax and email)

* Information about the products we sell you

* Financial information (purchase history) and bank account number · only in case of refund)

Provider

* Contact details (surname, first name, address, telephone, fax and email)

* Professional information (company, title/function, department, website)

* Financial and banking information (account number, credit history, and other financial information)

* Information allowing us to receive your products or services


Your Personal Data is always provided by yourself, on the occasion of a purchase made on the Website, or when subscribing to our Newsletter.

The banking data related to the payment of orders is exclusively collected and processed by our service provider Shopify payments (the processing of this personal data is carried out in accordance with Shopify's privacy policy, available on its website). Little Dudes does not have access to your bank account or payment card number (however, such data may be processed as part of a refund).


6. Recipients of Personal Data and guarantee in case of transfer to third countries

For the achievement of the purposes described in Article 3, we may transmit your data to third parties (the "recipients"):

  • External service providers and in particular IT and hosting service providers;

  • The service providers responsible for the delivery of your order.

Your Personal Data will be stored in Belgium or in another country of the European Economic Area.

Your Personal Data will not be disclosed to business partners for the purpose of commercial solicitations, without your express consent.


7. Retention Period of Personal Data

We will retain your Personal Data for no longer than is necessary to achieve the purposes for which they were collected.

8. Your rights regarding your Personal Data

You have the right to know whether or not Little Dudes processes Personal Data about you and when so, to access it and obtain information related to its processing.

You have the right to rectify Personal Data about yourself if it is inaccurate or to complete it if it is incomplete.

You have the right to request the erasure of your Personal Data when there is no longer a reason to process it.

9. Cookies

As part of the operation of the Website, we use cookies. The cookies used on the Website are mainly original cookies to manage the technical component of the Website (language, etc…).

10. Dispute resolution

This policy is exclusively governed by the GDPR and the laws that implement it in Belgian law, in particular the law of 30 July 2018 on the protection of individuals with regard to the processing of personal data, as well as other rules of Belgian law, excluding the rules of conflict of law.

Any dispute regarding the validity, application, interpretation or execution of this Policy which cannot be resolved amicably, will be the exclusive jurisdiction of the courts of Brussels that transpires in French.
